Extend Your H-2B!


Extension Eligibility

Individuals interested in extending their H-2B visa must meet the following requirements in order to be eligible:

  • Legal Status Participants must hold a current and valid I-94 card, and must be able to prove that they are currently working at the company that is listed on their visa. Proof may be provided in the form of payroll or pay-stubs.
  • H-2B Visa Expiration Participants must apply for an H-2B extension before their visa expires. It is better to apply for an H-2B extension at least 4 months prior to your visa expiring.
  • New Employment Start Date The start date for your new H-2B job may not start after your visa expires. The start date for your new placement must start either before your visa expires, or the day after your visa expires.
  • 3-Year Time Limit H-2B visa holders may only stay in the United States for a maximum of three consecutive years before returning home. If you are near the end of your 3 years in the U.S., you may not be able to apply for an H-2B extension. Please contact us so that we may check your eligibility.

    What is an H-2B visa extension?

    The H-2B visa extension allows H-2B participants to extend their visa for up to 3 years from the date they entered the United States. H-2B participants cannot extend their visa at the same company, but must work at a new company. They may return to the original company again during the next season.

    How can I apply for an H-2B extension?

    Please check out How to Extend? to learn more about the extension process. You will be required to fill out an application form and select some H-2B positions that you would be interested in applying for. After we receive your application, we will ensure that you have provided all the required documents for the extension, and then provide your resume to the employer. If you are selected for the position, you will receive an H-2B Job Offer for signature. We will then begin the process with U.S. Citizenship & Immigration Services to extend your H-2B visa.

    If I fill out an application for an H-2B extension, am I approved?

    No. By filling out an application for extension, you are letting us know that you are interested in extending your visa. It does not guarantee that you will be approved an extension. AAG cannot guarantee that we will find you a placement and that you will be approved by U.S. Citizenship & Immigration Services.

    What documents must I provide when I apply for an H-2B extension?

    You must complete the application and provide a resume or CV (Curriculum Vitae). You must also provide a copy of your valid passport, your current H-2B visa, copies of past H-2B visas, a copy of the front and back of your current I-94 card, and copies of any previous I-94 cards you may have if you are currently on an extension. You must provide both the front and back copy of the I-94 cards. In some cases, you may also have to provide copies of your paychecks or pay-stubs from your current H-2B host company.

    Does AAG approve my H-2B extension?

    No. AAG cannot approve visas. Only U.S. Citizenship & Immigration Services can approve your H-2B visa extension.

    Can I travel home while I am extending my H-2B visa?

    We recommend that H-2B participants do not travel outside the United States while on an H-2B extension. If you must travel outside the U.S. for any reason, you will need to go to the U.S. Embassy in your home country to apply for an H-2B visa to return to the United States. We cannot guarantee that you will be approved your visa.

    Will I have insurance coverage?

    Your H-2B Program does not include medical insurance, but it is highly recommended that while you are in the United States, you should have some insurance in case you become ill or are injured.     Can H-2B In-country participants leave their job?

    H-2B participants may not change jobs or leave their job without permission from both AAG and host company. You will also be required to show legal documentation proving a change of status or new visa status. If H-2B participants leave without permission or do not report to work for five consecutive days, their visa will be at risk of termination and a report will be sent to U.S. Citizenship & Immigration Services.

    How much does the H-2B extension cost?

    New federal regulations effective January 18, 2009, stated that H-2B participants are not allowed to pay a job placement fee or Program fee or other compensation (before or after the filing or approval of the H-2B petition) to an employer, recruiters, or any other party, in exchange for a job or offer of a job in the United States OR in your home country, in relation to the H-2B visa.

    What fees am I responsible for in order to extend my visa?

    Although you may no longer pay any Program fees or recruiter fees for your H-2B placement, you are allowed to continue to pay transportation fees, any government mandated passport fees and inspection fees. You will also be responsible for any housing costs, food, clothing, personal items, and incidentals, while you are working on an H-2B Program.

    Does AAG file the petitions premium processing?

    Yes, our nationally known, in-house attorney files every petition with premium processing. This means that U.S. Citizenship & Immigration Services must provide our office with information on the petition (approval, denial, or request for additional evidence) within fourteen (14) days.

    The petition for my H-2B extension has been filed to U.S. Citizenship & Immigration Services but it has not yet been approved, and my visa or I-94 card has already expired. Am I legal in the United States while my petition is pending?

    Yes. You are legal to stay in the United States, but you are not able to legally work until your petition has been approved.
